6552 sayılı (torba) yasa sonrası asıl işveren - alt işveren ilişkileri

Abstract

6552 sayılı (Torba) Yasa1 birçok başka konu yanında alt işveren uygulamasıyla ilgili önemli hükümler getirmiştir. Bunlar arasında asıl işverenlerin alt işverence kendi işçilerine ücret ödemesi yapılıp yapılmadığını; yıllık izin kullandırılıp kullandırılmadığını denetleme zorunlulukları başta gelmektedir. Yasa bunların yanında ve alt işveren işçilerini koruma gayesiyle kamu (asıl) işverenlerine kıdem tazminatı ödeme yükümlülüğü açısından önemli sorumluluklar getirmektedir. Bu çalışma 6552 sayılı Yasa'nın bütününü değil, bahsedilen asıl işveren-alt işveren ilişkileri boyutunu incelemeyi amaçlamaktadır.

Beside some subjects related to other fields of labour law, the Law No: 6552 brought new rules about the subcontractor. The duties of the employer to check if the subcontractor is paying the wages and if the subcontractor is giving the annual paid leave to his employees are the most important ones among these new provisions. Else, the Law 6552 has put the burden of severence pay to the shoulders of the public sector employer instead of the subcontractor. This article aims to explore the new provisions of the Law No: 6552 related to the subcontractor.
