Türkiye’de İş Aracılığı Hizmetlerinin Tarihsel Gelişim Sürecinde Kamu Tekelinin Kırılması

Abstract

1990’lı yıllardan itibaren çalışma hayatında katı ve sınırlayıcı düzenlemelerin yerini, değişen sosyo-ekonomik koşullara uyum sağlayabilecek esnek düzenlemeler almaya başlamıştır. Çalışma hayatındaki esneklik arayışları, iş aracılığı hizmetlerini de etkilemiş; iş aracılığı hizmeti ile ilgili gerek ulusal düzenlemelerde, gerekse uluslararası düzenlemelerde devlet tekeli anlayışından uzaklaşılırken, özel istihdam bürolarının iş piyasasındaki etkinlikleri artmaya başlamıştır. Türkiye’de ise, iş aracılığı hizmetleri yarım yüzyılı aşkın bir süre devlet tekelinde kalmış; ancak 2000 yılından itibaren çıkartılan yasal düzenlemelerle birlikte iş aracılığı hizmetinde, özel istihdam bürolarının da faaliyet gösterdiği, yeni bir döneme girilmiştir.

Bu çalışmada da Türkiye’de iş aracılığı hizmetleri kronolojik olarak incelenmeye çalışılmıştır. Çalışmada Türkiye’de iş aracılığı hizmetleri, çıkartılan yasal düzenlemeler ışığında, kamu tekelinin yaşandığı dönem ve kamu tekelinin kırıldığı dönem olmak üzere iki dönem altında ele alınmış ve özel istihdam bürolarının faaliyetleri üzerinde durulmuştur.

The flexible regulations, which could be adaptable to the volatile socio-economic conditions, have been taken the place of the strict and restrictive regulations in the working life since the 1990’s. The searching for flexibility in the working life has also affected the employment services; the private employment agencies have been getting more effective in the working life while leaving the case of the state monopoly both in the national and the international regulations concerning the employment services. There had been a state monopoly in the employment services for more than a half of a century in Turkey, but with the introduction of the new legal regulations since 2000, a new era has begun in which the private employment agencies has also come into effect in the employment services.

In this study, the employment services in Turkey are tried to be examined chronologically. The employment services in Turkey are elaborated within two periods considering the legal regulations, as the state monopoly period and the discarded state monopoly period and the private employment agencies are dwelled on.
